Terms of service

These Terms of Service govern your use of the VAZIMOON website and any purchase you make from it. VAZIMOON is a brand operated by LOUBINETTE LLC. In these terms, "we", "us" and "our" refer to LOUBINETTE LLC trading as VAZIMOON, and "you" refers to you, the user or customer.

By visiting our site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

1. Use of the website

You may use this site to browse our products and place orders for your own use. You agree not to use the site for any unlawful purpose, and not to use it in a way that could damage, disable or impair the site or interfere with anyone else's use of it.

You must be of legal age to form a binding contract in your place of residence in order to place an order.

2. Online store terms

We may update, change or discontinue any part of the site, including products and content, at any time and without notice. We may also limit the availability of any product or service to any person or geographic region.

3. Product information

We describe our products as accurately as we reasonably can. Our items are printed or embroidered individually, and garment styles differ between products.

Product photographs and mockups are representations. Colours can appear differently on different screens, and small variations in print placement or finish can occur between individual items produced by hand-operated processes. Where a variation goes beyond normal production characteristics and amounts to a genuine defect, our Refund Policy applies.

Sizing is not identical across our range. Please refer to our Size Guide before ordering, or contact us for the measurements of a specific product.

4. Pricing

Prices are shown on the product page and are confirmed at checkout. Shipping costs, where they apply, and any applicable taxes are calculated and displayed at checkout before you complete your order.

We may change prices at any time. A price change does not affect an order that has already been accepted and paid for. International orders may additionally be subject to customs duties or import taxes charged by the destination country, as explained in our Shipping Policy.

5. Product availability

Products are offered subject to availability, including the availability of the garments and materials used by our fulfillment partners. A product being visible on the site is not a guarantee that it can be produced. If we cannot fulfil an order, we will contact you and issue a refund.

6. Orders and acceptance

Your order is an offer to buy. A contract is formed when we accept your order and confirm it to you. We reserve the right to refuse or cancel any order where doing so is lawful and appropriate — for example where a product is unavailable, where there is an error in the price or product description, where we suspect fraudulent or unauthorised activity, or where we are unable to ship to the address provided.

If we cancel an order that you have already paid for, we will refund it in full to the original payment method.

7. Made-to-order products

Most VAZIMOON products are produced individually after you order. Production typically begins soon after an order is placed. As a result, changes and cancellations cannot be guaranteed once production has started, and our approach to returns differs from a store shipping from stock. Please see our Refund Policy, which forms part of these terms.

8. Billing and account information

You agree to provide current, complete and accurate purchase and account information, including a valid shipping address and contact details, and to update that information as needed so that we can complete your order and contact you about it.

Payments are processed by our payment providers. We do not store your full payment card details.

9. Shipping

Shipping, transit estimates, tracking, split shipments, customs and delays are covered in our Shipping Policy, which forms part of these terms. All delivery timings we publish are estimates and not guaranteed dates.

10. Returns and refunds

Returns, replacements and refunds are covered in our Refund Policy, which forms part of these terms. Nothing in these terms limits any rights you may have under applicable consumer law.

11. Intellectual property

All designs, artwork, graphics, text, photographs, logos and other content on this site are owned by us or used by us under licence, and are protected by intellectual property laws. You may not reproduce, copy, resell, distribute or create derivative works from our designs or site content without our prior written permission.

Buying a product gives you ownership of that physical item. It does not transfer any rights in the design printed on it.

12. User submissions

If you send us comments, suggestions, reviews, photographs or other material, you grant us a non-exclusive, royalty-free right to use, reproduce and publish that material in connection with our business, and you confirm that the material is yours to share and does not infringe anyone else's rights. We may remove or decline to publish any submission at our discretion. We are not obliged to keep submissions confidential or to pay compensation for them.

13. Third-party services and links

Our site relies on third-party services, including our ecommerce platform, payment providers, fulfillment partners and shipping carriers. It may also contain links to third-party websites. We are not responsible for the content, policies or practices of third parties, and your dealings with them are governed by their own terms.

14. Prohibited uses

You may not use the site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to infringe our or any third party's intellectual property rights; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track the personal information of others; to spam, phish, scrape or crawl in a manner that burdens the site; or to interfere with or circumvent the security features of the site or any related service.

We may terminate your use of the site for breach of this section.

15. Errors and inaccuracies

Occasionally there may be information on the site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping estimates or availability. We reserve the right to correct any errors and to update information at any time without prior notice, including after an order has been submitted. Where an order is affected by a material error, we will contact you and offer you the choice of proceeding at the corrected terms or cancelling for a full refund.

16. Disclaimer of warranties

We aim to keep the site available and accurate, but we do not warrant that its operation will be uninterrupted, timely, secure or error-free, or that all content is entirely accurate at all times. To the extent permitted by applicable law, the site and our products are provided without warranties of any kind other than those that cannot lawfully be excluded. Nothing in this section affects any warranty or guarantee that applies to you under mandatory consumer law.

17. Limitation of liability

To the extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses arising out of your use of the site or of any product purchased through it. Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited — including your non-waivable rights under applicable consumer law.

18. Indemnification

You agree to indemnify and hold harmless LOUBINETTE LLC and its officers, employees and partners from any third-party claim arising out of your breach of these terms or your violation of any law or of the rights of a third party.

19. Termination

These terms remain in effect while you use the site. We may terminate or suspend your access at any time if we reasonably believe you have breached them. Obligations and liabilities incurred before termination survive it.

20. Severability

If any provision of these terms is found to be unlawful, void or unenforceable, that provision applies to the fullest extent permitted by law, and the remaining provisions continue in full force and effect.

21. Entire agreement

These terms, together with our Privacy Policy, Refund Policy and Shipping Policy, make up the entire agreement between you and us regarding your use of the site and any purchase from it, and replace any prior agreements or communications on that subject.

22. Changes to these terms

We may update these terms from time to time. The version published on this page is the version that applies. Changes take effect when published, and your continued use of the site after that constitutes acceptance of the updated terms. Orders already accepted are governed by the terms in force when they were placed.

23. Governing law

LOUBINETTE LLC is a limited liability company formed in the State of Montana, United States. These terms, and any dispute arising out of or in connection with them or with any purchase made through this site, are governed by the laws of the State of Montana, without regard to its conflict of law provisions.

If you are a consumer, this choice of law does not deprive you of the protection of any mandatory provisions of the law of the country or state in which you are habitually resident. Where the law of your place of residence gives you rights that cannot be waived by agreement, those rights continue to apply, and nothing in these terms, our Refund Policy, our Shipping Policy or any other store policy limits them.

Subject to the paragraph above, you and we agree that any dispute arising out of these terms may be brought before the state or federal courts located in the State of Montana. This does not affect any right you may have under applicable law to bring proceedings in the courts of your own place of residence.
